Read this before you sign the "Affidavit of Paternity"

Unmarried parents can voluntarily establish paternity of a child by filing a notorized Affidavit of Paternity where the child is born. The affidavit is a sworn agreement about paternity. Neither parent should sign if either has any doubts about the truth of the affidavit. Before signing, parents must be advised of the rights and responsibilities of parents, legal consequences, and alternatives to signing the document. This information must be presented orally, in addition to that contained in the affidavit. Affidavit of Paternity is a legal document and should be taken seriously. The Affidavit of Paternity is often tied to the birth certificate and some hospitals are reimbursed for each affidavit they turn in. Bigger incentives for hospitals to collect voluntary signatures at the time of the child's birth is more reason to error on the side of caution.

It's Best To Test!

I had a recent situation where a gentleman signed the Affidavit of Paternity at the hospital his name was then added to the birth certificate and he would be responsible for that child for the next 20 years. He decided to get tested a month later finding out he was NOT the father of the child. Now he is faced with additional legal fees as he will now need a court order to have his name removed from the birth certificate.

"Putative Father Registry"

The Putative Father Registry allows (putative) fathers of children born out of wedlock to register if they wish to be notified of any termination of parental rights or adoption proceedings with that child. You need to file before the child is born or up to 30 days after the child is born. You will not be named the father until the paternity test is done. Putative father may at any time revoke a notice of intent to claim paternity.
